Mexico Labor Reform
What you need to know and what does it mean for the service providers
Sharing updates with you
What’s happening?
As you may be aware, the Labor Reform has officially taken effect, and companies are now required to contribute to social security for eligible service providers
How does this affect inDrive?
inDrive has a unique business model, where users and service providers can directly negotiate prices and conduct fair deals. Even though the law was designed based on a traditional RH business model, and our price negotiation model is different, we recognize the importance of social protections.

General questions
What does it mean to me?
"The labor reform in Mexico states that service providers, like drivers and couriers, should now receive social security benefits if they meet the criteria set by law. This means that if your net monthly income - as defined by regulation (your gross income after applicable deductions) - is more than the minimum income in Mexico City, we’ll register you for full social security contributions and cover all the costs, including housing contributions (INFONAVIT).
What is the net monthly income?
Net monthly income is calculated on the basis of your gross monthly income, with the exclusion of a certain percentage as established by the government. Such net monthly income, after the applicable deductions, should be equivalent to the minimum monthly wage in Mexico City (i.e., 8364 MXN). Currently, to meet the criteria, based on your vehicle type, your gross monthly income must be at least: Car: $20,910 MXN. Motorcycle: $16,728 MXN. Important note: These amounts apply during the first three months of the IMSS pilot and have been set by the government, though they may be subject to change for the months of October to December. It is estimated the government will publish the new amounts by September.
Will I have to pay more taxes? Will my tax regime change?
As we understand, the tax regime does not change because of the reform. You shall continue to pay taxes in the same way you have been doing it previously (i.e., inDrive will not be withholding and paying taxes envisaged by the labour laws on your behalf).
How will this affect my earnings?
Even with these changes, our take rate will remain one of the lowest in Mexico — and we are committed to keeping this position. We will also maintain our Peer-to-Peer model, that allows you to negotiate the price directly and accept only the services you want with the price you like. With us, you will continue to be the owner of your work.
What happens if I don’t want the IMSS social security coverage?
If your monthly earnings with inDrive are below the eligible net monthly income in the corresponding month, nothing will change for you. However, If you meet the criteria set by the regulation, inDrive is required by law to provide social security to you. For more details, please contact IMSS.
inDrive takes care of the process.
If your net monthly income qualifies, you’ll be automatically registered with IMSS. Please note that inDrive may require additional information from you to do so.

Frequently asked questions
How will I know that I already have IMSS social security coverage?
You need to earn the eligible net monthly income in the corresponding month. You can also check with the IMSS. Please note that coverage will only be provided in the months where you have reached the eligible net monthly income.
I’m a pensioner — can I opt out of the insurance?
If you get a pension from IMSS, your current pension status won’t change.
When does the reform take effect? Do I need to do anything myself?
The pilot phase of the reform started in July and will run until December 2025. Right now, you don’t need to take any extra steps. We’re adjusting to the new rules together with you and the rest of the market. We also promise to keep you informed about any important updates.
Will contributions also go to INFONAVIT?
Yes, if you qualify for social security, i.e., if you make at least the equivalent of the net income in the corresponding month, contributions should be made to INFONAVIT on your behalf.
What happens if I work on several platforms?
On the platform you reach the net minimum monthly income you will receive social security. The benefits are not mutually exclusive from one platform or another.
